Eleantis establishes this Privacy Policy, which aims to transparently inform Users about the website hosted at the following address: www.eleantis.be (hereinafter the "Site"), and about the manner in which personal data is collected and processed by Eleantis.
The term "User" refers to any user, whether a natural or legal person, who visits the Site or interacts with it in any way.
In its capacity as Data Controller, Eleantis determines all technical, legal and organisational means and the purposes for the processing of Users' personal data. Eleantis commits to taking all necessary measures to ensure that the processing of personal data takes place in accordance with the Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data (hereinafter the "Act") and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (i.e. the General Data Protection Regulation (GDPR); hereinafter the "Regulation").
Eleantis is free to choose a natural or legal person who processes Users' personal data at its request and on its behalf (hereinafter the "Processor" or "Subcontractor"). Where applicable, Eleantis commits to selecting a Processor that provides sufficient guarantees with regard to technical and organisational measures for the processing of personal data, in accordance with the Act and the Regulation.
2. Processing of personal data
Users' use of the Site may result in the collection of personal data. The processing of this data by Eleantis, in its capacity as Data Controller or by service providers acting on behalf of and for the account of Eleantis, takes place in accordance with the Act and the Regulation.
Personal data is processed by Eleantis, in accordance with the purposes listed below, through the following methods:
- Sending our newsletter and/or promotional brochure
- Being able to call or email you if necessary to perform our services
- Informing you of changes to our services and products
- Eleantis analyses your behaviour on the website in order to improve the website and to align the range of products and services with your preferences
- By applying for a job at Eleantis, we collect the information you provide to us, such as identity data, CV and cover letter
3. Purpose of personal data processing
In accordance with Article 13 of the Regulation, the purposes of personal data processing are communicated to the User. Those purposes are as follows:
- Sending our newsletter and/or promotional brochure, with 'consent' as the legal basis
- Being able to call or email you if necessary to perform our services, with 'consent' as the legal basis
- Giving you the opportunity to create an account, with 'consent' as the legal basis
- We track your browsing behaviour across different websites to align our products and services with your needs, with 'consent' as the legal basis
4. Personal data that may be processed
The User agrees that, during the visit and use of the Site, Eleantis collects and processes the following personal data:
- First and last name
- Address details
- Phone number
- Email address
- Other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone
- Data about your browsing behaviour across different websites (for example because this company is part of an advertising network)
- Internet browser and device type
Eleantis collects and processes this personal data in accordance with the conditions and principles described in this Privacy Policy.
5. Consent
By accessing and using the Site, the User declares that they have read and given their free, specific, informed and unambiguous consent to the processing of their personal data. This agreement relates to the content of this Privacy Policy.
Consent is given by the positive and active action by which the User has ticked the checkbox for the privacy policy via a 'hypertext link'. This consent is an essential condition for carrying out certain actions on the Site or to enable the User to enter into a contractual relationship with Eleantis. Any agreement binding Eleantis and a User with regard to the services and goods offered on the Site is subject to the User's acceptance of the Privacy Policy.
The User agrees that the Data Controller, in accordance with the conditions and principles contained in this Privacy Policy, collects and processes their personal data which they provide on the Site or in connection with the services offered by Eleantis, for the purposes mentioned above.
The User has the right to withdraw this consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on prior consent.
6. Retention period of users personal data
In accordance with Article 13(2) of the Regulation, the Data Controller retains personal data only for as long as is reasonably necessary to achieve the purposes for which it is processed.
This period shall in all cases be no longer than two years.
7. Recipients of data and disclosure to third parties
Personal data may be transferred to employees, associates, subcontractors, processors or suppliers of Eleantis insofar as adequate guarantees are provided for the security of the data and insofar as they collaborate with Eleantis for the marketing of products or the provision of services. They act under the direct authority of Eleantis and are specifically responsible for collecting, processing or outsourcing this data.
In all cases, the recipients of the data and those to whom the data is provided comply with the content of this Privacy Policy. Eleantis ensures that they process this data only for the intended purposes and in a discreet and secure manner.
In the event that the data is provided to third parties for purposes of direct marketing or prospecting, the User will be informed in advance so that they can give their prior and express consent to this use of personal data.
8. Rights of users
The User may exercise their rights at any time by sending a message by email to the following address: info@eleantis.be, or a letter by post, accompanied by a copy of their identity card, to the following address: Industriepark 1231, 3545 Halen.
Right of access
In accordance with Article 15 of the Regulation, Eleantis guarantees the User's right of access to their personal data. The User has the right to access this personal data and the following information:
- The categories of personal data concerned
- The recipients or categories of recipients to whom the personal data has been or will be disclosed
- Where the recipients are established in third countries or are international organisations, the appropriate or suitable safeguards
- Where possible, the proposed storage period for personal data or, if this is not possible, the criteria used to determine this period
- The existence of automated decision-making, including profiling, as referred to in Article 22(1) and (4) of the Regulation, and, at least in such cases, meaningful information about the underlying logic, as well as the significance and the envisaged consequences of such processing for the data subject
The Data Controller may charge a reasonable fee based on administrative costs for additional copies requested by the User.
Where the User submits this request by electronic means (e.g. via the email address), the information shall be provided in electronic form and for general use, unless the User requests otherwise.
The copy of the data will be communicated to the User no later than one month after receipt of the request.
Right to rectification
Eleantis guarantees the User the right to rectification and deletion of personal data.
In accordance with Article 16 of the Regulation, incorrect, inaccurate or irrelevant data may be corrected or deleted at any time. The User first makes the necessary changes themselves from their user account, unless these cannot be made independently, in which case the request may be directed to Eleantis.
In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data has been disclosed of any rectification of the personal data, unless this proves impossible or involves disproportionate effort. The Data Controller provides the data subject with information about these recipients if the data subject requests it.
Right to erasure
The User has the right to obtain the erasure of their personal data as soon as possible in the cases referred to in Article 17 of the Regulation.
Where the Data Controller has made the personal data public and is obliged under the preceding paragraph to erase it, the Data Controller, taking into account available technology and the cost of implementation, shall take reasonable measures, including technical measures, to inform other data controllers processing such personal data that the data subject has requested the erasure by such data controllers of any links to, or copies or reproductions of, that personal data.
The two preceding paragraphs do not apply to the extent that such processing is necessary for:
- The exercise of the right to freedom of expression and information
- Compliance with a legal obligation to process under Union or Member State law to which the Data Controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller
- The establishment, exercise or defence of legal claims
In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data has been disclosed of any erasure of personal data or any restriction of its processing, unless this proves impossible or involves disproportionate effort. The Data Controller provides the data subject with information about these recipients if the data subject requests it.
Right to restriction of processing
The User has the right to obtain a restriction of the processing of their personal data in the cases referred to in Article 18 of the Regulation.
In accordance with Article 19 of the Regulation, the Data Controller notifies each recipient to whom the personal data has been disclosed of any restriction of processing carried out, unless this proves impossible or involves disproportionate effort. The Data Controller provides the data subject with information about these recipients if the data subject requests it.
Right to data portability
In accordance with Article 20 of the Regulation, Users have the right to receive their personal data from Eleantis in a structured, commonly used and machine-readable format. Users have the right to transmit this data to another Data Controller without Eleantis preventing this, in the cases provided for in the Regulation.
Where the User exercises their right to data portability pursuant to the preceding paragraph, they have the right to have personal data transmitted directly from one Data Controller to another, where technically feasible.
The exercise of the right to data portability does not affect the right to erasure. This right does not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Data Controller.
The right to data portability does not affect the rights and freedoms of third parties.
Right to object and automated individual decision-making
The User has the right at any time to object to the processing of their personal data on grounds relating to their particular situation, including the automation of data by Eleantis. In accordance with Article 21 of the Regulation, Eleantis will no longer process personal data unless there are legitimate and compelling reasons for the processing that override the interests and rights and freedoms of the User, or for the establishment, exercise or defence of legal rights.
Where personal data is processed for prospecting purposes, the User has the right at any time to object to the processing of personal data concerning them for such prospecting purposes, including profiling to the extent that it relates to such prospecting.
Where the data subject objects to processing for direct marketing purposes, the personal data shall no longer be processed for such purposes.
Right to lodge a complaint
The User has the right to lodge a complaint regarding the processing of their personal data by Eleantis with the Data Protection Authority competent for Belgian territory. More information can be found on the website: https://www.gegevensbeschermingsautoriteit.be/.

The User may also bring an action for injunction before the President of the Court of First Instance of their place of residence.
9. Cookies

10. Limitation of liability of the data controller
The website may contain links to other third-party websites that are not affiliated with Eleantis. The content of these sites and compliance with the Regulation and the Act are not the responsibility of Eleantis.
The holder of parental authority must give their express consent to a minor under the age of 16 to disclose personal information or data through the Site. Eleantis strongly advises persons exercising parental authority over minors to promote responsible and safe use of the internet. The Data Controller cannot be held liable for the collection and processing of personal information and data of minors under the age of 16 whose consent is not effectively covered by that of their legal parents, nor for incorrect data — particularly regarding age — entered by minors. In no case will personal data be processed by the Data Controller if the user indicates that they are under the age of 16.
Eleantis is not responsible for the loss, damage or theft of personal data, particularly as a result of the presence of viruses or following computer attacks.
11. Safety and security
The Data Controller implements technical and organisational measures to ensure an appropriate level of security for the processing and collection of data. These security measures depend on the implementation costs in relation to the nature, context and purposes of the processing of personal data.
The Data Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Site.
12. Amendment of the privacy policy
Eleantis reserves the right to amend this Privacy Policy to comply with the legal obligations in this regard. The User is therefore requested to consult the Privacy Policy regularly in order to stay informed of any changes and adjustments. Such changes will be posted on the Site or sent by email to ensure enforceability.
13. Applicable law and competent court
This Privacy Policy is governed exclusively by Belgian law. Any dispute will be submitted to the courts of the judicial district of the registered office of Eleantis.
